Deportation/Removal

Any individual in the country without being a citizen may be subject to expulsion or removal proceeding. If the immigration authorities allege a violation of immigration laws, it has the discretion to "serve" the alien with a charging document, known as a Notice to Appear in the USA or an "expulsion Letter" in Spain. This document orders in both countries orders the individual to appear before to be removed or give account as to why he/she should not be removed, and advises him or her of, among other things:

  • Nature of the proceedings against the individual;
  • Individual's alleged acts that violated the law;
  • Individual's right to an attorney; and
  • Consequences of failing to appear at scheduled hearings.

Removal proceedings generally require the authorities to make two findings: (1) a determination of the inidvidual's removability, and (2) whether the individual is eligible for a form of relief from removal.
